Terms and Conditions built around clarity and fair use

These Terms explain the rules that apply when you visit the ActiveTrader website, purchase or receive a digital product, activate a licence, use technical support, or access related resources.

These Terms and Conditions (“Terms”) form a legal agreement between the person or organisation using the website or purchasing a product (“Client”, “you”, or “your”) and ActiveTrader (“ActiveTrader”, “we”, “us”, or “our”).

Please read these Terms together with the applicable product page, order confirmation, Licence Guide, Refund Policy, Privacy Policy, and Risk Disclosure. If a product-specific term conflicts with a general term, the more specific written term shown at the time of purchase will apply to that product, subject to applicable law.

Acceptance of These Terms

You accept these Terms when you access or use the website, place an order, check the acceptance box at checkout, download a digital file, submit account details for activation, activate a licence, or use the product or support services.

If you do not agree, do not place an order, download the product, submit activation details, or use the product.

If you act for a company or another person, you confirm that you have authority to bind that party to these Terms.

About ActiveTrader and Service Scope

ActiveTrader develops, licenses, documents, and supports automated trading software designed for MetaTrader 5 and selected market instruments.

ActiveTrader is a technology and software provider. ActiveTrader is not a broker, bank, custodian, investment fund, deposit provider, exchange, payment institution, or manager of client trading capital.

Unless expressly agreed in a separate written contract, ActiveTrader does not take custody of client funds, execute withdrawals, make personal investment decisions for clients, or guarantee a trading outcome.

Eligibility and Lawful Use

To purchase or use an ActiveTrader product, you must:

  • be at least 18 years old and legally capable of entering a contract;
  • provide accurate and complete order and activation information;
  • use the product only where automated trading and the relevant broker services are lawful;
  • comply with the rules of your broker, platform, payment provider, and jurisdiction; and
  • not be subject to sanctions, restrictions, or legal prohibitions that prevent the transaction or use.

We may request reasonable identity, payment, account, or ownership verification before delivery, activation, account replacement, or support.

Products, Descriptions, and Operating Requirements

Each product page describes the relevant platform, supported instruments, minimum operating balance, licence options, installation requirements, and other product-specific conditions.

Product descriptions are intended to be accurate and understandable. Minor visual differences, documentation updates, interface changes, or non-material revisions do not make a product defective where its core licensed function remains substantially available.

A stated minimum balance is an operating requirement, not a guarantee of profit, maximum drawdown, safety, trade frequency, or account survival.

You are responsible for confirming that your broker offers the required symbols, account type, leverage, execution environment, and MetaTrader 5 access before purchasing.

Orders and Contract Formation

Submitting an order is an offer to purchase the selected product and licence. An automated order acknowledgement does not by itself guarantee acceptance.

The contract is formed when ActiveTrader accepts the order by sending confirmation, making the digital product available, or completing licence activation, whichever occurs first.

We may refuse or cancel an order before delivery or activation where there is a pricing error, suspected fraud, payment failure, sanctions concern, unsupported jurisdiction, incompatible request, inaccurate information, or another reasonable legal or operational reason. Where payment has been received and no product or activation has been delivered, the amount received will be returned subject to applicable law and payment-provider processing.

Prices, Taxes, Currency, and Payment

The price displayed at checkout or in a written quotation applies to the selected order unless an obvious error is identified before acceptance.

Prices may change for future orders without changing a licence already purchased and accepted. Unless stated otherwise, the Client is responsible for any applicable bank fees, currency-conversion costs, taxes, duties, withholding obligations, or third-party payment charges.

Payment must be made using an authorised payment method. A chargeback or payment reversal does not automatically cancel the licence or resolve a dispute. Please contact ActiveTrader first so the issue can be investigated.

Digital Delivery and Manual Activation

ActiveTrader products are digital products. Delivery may include downloadable files, documentation, account access, activation confirmation, licence registration, or a combination of these items.

Licence activation normally requires the correct:

  • selected product and licence type;
  • MetaTrader account number;
  • broker name;
  • exact broker server; and
  • any additional information reasonably required to verify the licence request.

The Client must check all submitted information. Delays or failed activation caused by incorrect, incomplete, changed, or unsupported account details are not product defects.

Never send a broker master password, withdrawal credential, email password, payment credential, or permanent VPS administrator password to ActiveTrader.

Licence Types and Account Capacity

Each licence applies to one selected ActiveTrader product only. A licence for one product does not activate another product.

Personal Licence Lifetime 1 fixed real account and 1 additional demo activation. The activated real account number and broker cannot be changed after activation.
3 Corporate Licence Lifetime Up to 3 approved real-account slots and 1 additional demo activation. Account numbers may be replaced within the purchased quota.
10 Corporate Licence Lifetime Up to 10 approved real-account slots and 1 additional demo activation. Account numbers may be replaced within the purchased quota.

Corporate account use

A Corporate licence may be used for company or client accounts only within the purchased quota and under the control of the original purchaser. It does not permit resale, sublicensing, public distribution, or transfer of the licence itself.

Replacement verification

For Corporate licences, ActiveTrader may require reasonable proof that an account replacement is requested by the original purchaser and remains within the active licence quota.

Meaning of “Lifetime”

“Lifetime” means that the accepted licence does not require a recurring licence subscription fee and may continue to be used for as long as the relevant product, supported platform, activation infrastructure, and lawful technical environment remain reasonably available.

“Lifetime” does not mean the natural lifetime of the purchaser and does not guarantee perpetual compatibility with every future MetaTrader build, operating system, broker change, regulatory change, third-party service, hardware environment, or market condition.

Free updates are included when ActiveTrader releases an update for the same licensed product generation. A materially new product, separate edition, or replacement product may require a separate licence unless ActiveTrader states otherwise.

Permitted Use

Subject to payment, acceptance, and compliance with these Terms, ActiveTrader grants a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the selected product on the approved accounts within the purchased licence capacity.

You may:

  • install and operate the product for authorised trading activity;
  • create reasonable backup copies for your own licensed use;
  • use official presets, documentation, and updates for the licensed product; and
  • request support for the original purchaser and approved accounts.

Prohibited Use

You must not, directly or indirectly:

  • sell, rent, lease, sublicense, transfer, share, publish, or redistribute the product or licence;
  • share the product with an unapproved account or exceed the purchased quota;
  • reverse engineer, decompile, disassemble, extract, bypass, or attempt to discover protected source code or licence logic, except where a mandatory law expressly permits limited activity;
  • remove copyright, branding, licence, security, or attribution notices;
  • circumvent account controls, activation limits, expiry checks, or security measures;
  • use the product for unlawful activity, deception, unauthorised account access, or infringement of another person’s rights;
  • represent yourself as ActiveTrader, an official representative, or an authorised reseller without written approval; or
  • make false or misleading performance, profit, guarantee, or affiliation claims using the ActiveTrader name.

Account Data, Credentials, and Security

You are responsible for protecting your website, Client Portal, email, broker, payment, VPS, and trading-platform credentials.

ActiveTrader may request account number, broker, and server information for activation and support. ActiveTrader does not need your broker withdrawal credential or master password to activate a normal software licence.

Notify ActiveTrader promptly if you believe that your order, licence, files, or Client Portal account has been accessed without authorisation.

MetaTrader, Brokers, VPS, and Other Third-Party Services

MetaTrader, brokers, VPS providers, payment processors, monitoring services, copy trading platforms, and other third parties are independent from ActiveTrader.

Their services are governed by their own contracts, pricing, execution policies, eligibility rules, maintenance schedules, privacy practices, and legal requirements.

A recommended or affiliate link does not make ActiveTrader responsible for a third party’s:

  • account approval or rejection;
  • deposits, withdrawals, fees, leverage, margin, spreads, commissions, or execution;
  • server availability, latency, slippage, symbol specifications, or trade rejection;
  • VPS resources, uptime, security, backup, or data loss;
  • subscription, billing, cancellation, or refund decisions; or
  • legal availability in a particular country.

ActiveTrader may receive an affiliate or referral benefit from a disclosed partner link without increasing the licence rights granted under these Terms.

Copy Trading, Investor Access, and Performance Information

Copy trading profiles, Investor Access information, account statements, monitoring links, backtests, screenshots, historical results, demo results, and live results are provided for information and transparency.

They do not guarantee that a Client will achieve the same result. Differences may arise from balance, leverage, lot size, broker, spread, commission, liquidity, slippage, latency, symbol specifications, execution, settings, deposit or withdrawal activity, start date, and market conditions.

Historical MT4 profiles are not the same product as current MT5 products unless expressly stated.

Client Responsibilities and Trading Risk

You retain full responsibility for deciding whether automated or leveraged trading is suitable for you.

You are responsible for:

  • the capital deposited with your broker;
  • broker selection, account type, leverage, and account currency;
  • lot, risk, equity, drawdown, stop, and exposure settings available to you;
  • keeping MetaTrader, the EA, internet connection, and VPS operational;
  • monitoring open positions, margin, equity, logs, and alerts;
  • understanding that trading can lose part or all of the account balance; and
  • obtaining independent legal, tax, accounting, or financial advice where needed.
Trading loss, drawdown, fewer trades than expected, different execution, or a result below expectation does not by itself prove that the software is defective.

Updates, Compatibility, and Support

Eligible licences include product support and free updates when ActiveTrader releases them for the same product generation.

Support may include installation guidance, licence verification, account and server checks, official documentation, and reasonable troubleshooting.

Support does not include:

  • guaranteed trading profit or personal investment advice;
  • management of broker funds or withdrawal disputes;
  • repair of third-party hardware, operating systems, broker servers, or VPS infrastructure;
  • support for modified, cracked, redistributed, or unauthorised files;
  • custom development unless separately agreed in writing; or
  • guaranteed compatibility with every future third-party change.

ActiveTrader may require screenshots, logs, platform version, product name, account number, broker, and server details to investigate a support request.

Cancellations, Refunds, and Fair Resolution

Refund requests are governed by the separate Refund Policy and any mandatory rights under applicable law.

Before digital delivery or activation

If you contact ActiveTrader before the product is downloaded, made available, or activated, we will review a cancellation request in good faith. A refund may be available where delivery and activation have not begun, subject to payment processing, fraud review, and applicable law.

After delivery, download, or activation

Because the product is digital and the licence may be individually activated, purchases are generally non-refundable after delivery, download, access, or activation.

ActiveTrader will nevertheless review reasonable claims involving:

  • a duplicate payment;
  • delivery of the wrong product caused by ActiveTrader;
  • a verified failure to deliver or activate after a reasonable opportunity to correct the issue;
  • a material failure of the delivered product to match its written description; or
  • a remedy required by applicable law.

Before deciding a technical claim, ActiveTrader may request a reasonable opportunity to inspect the installation, account compatibility, platform logs, activation data, and error evidence.

Trading loss, market movement, broker execution, unsuitable settings, unsupported symbols, failure to meet the stated balance, or changing your mind after delivery is generally not a refund basis.

Website, Licence Server, and Service Availability

We aim to keep the website, download access, activation systems, and support resources reasonably available, but uninterrupted or error-free operation cannot be guaranteed.

Temporary interruption may occur because of maintenance, security work, hosting failure, internet disruption, software updates, third-party changes, legal requirements, or events outside our reasonable control.

Where reasonably possible, ActiveTrader may provide an alternative activation, updated file, workaround, restoration, or support response.

Intellectual Property and Ownership

ActiveTrader and its licensors retain ownership of the software, source code, compiled files, licence systems, documentation, presets, design, website content, trademarks, logos, text, graphics, and other protected materials.

Purchasing a product grants a limited right to use it under these Terms. It does not transfer ownership of the software, intellectual property, source code, brand, or business methods.

Client feedback may be used to improve products and services without identifying the Client, unless a separate written agreement states otherwise.

Suspension, Refusal, and Termination

ActiveTrader may temporarily suspend access, activation, replacement, downloads, or support where reasonably necessary to investigate:

  • non-payment, chargeback, or fraudulent payment;
  • licence sharing, resale, cracking, reverse engineering, or quota abuse;
  • unauthorised account use or false ownership information;
  • security threats, malware, abusive conduct, or unlawful activity;
  • material breach of these Terms; or
  • a legal or regulatory requirement.

Where the issue can reasonably be corrected, we may provide notice and an opportunity to cure before permanent termination. Immediate action may be taken where necessary to protect security, intellectual property, clients, third parties, or legal compliance.

Termination for material breach does not create a refund right unless required by law.

Disclaimers

To the fullest extent permitted by applicable law, products and services are provided on an “as available” basis with the features and limitations described at the time of purchase.

ActiveTrader does not promise or warrant:

  • profit, fixed return, trade frequency, recovery, or maximum drawdown;
  • identical results between accounts, brokers, or users;
  • continuous compatibility with every future broker, MetaTrader build, operating system, or VPS;
  • uninterrupted internet, broker, VPS, platform, licence-server, or third-party availability; or
  • that every product is suitable for every Client, account, jurisdiction, or risk tolerance.

Nothing in these Terms excludes a warranty, consumer right, or remedy that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, ActiveTrader will not be liable for indirect, incidental, special, punitive, exemplary, or consequential loss, including loss of profit, trading capital, opportunity, goodwill, data, or business interruption.

ActiveTrader is not responsible for loss caused by market movement, leverage, margin call, liquidation, broker execution, spread, slippage, commission, latency, unsupported symbols, incorrect settings, platform failure, VPS failure, internet failure, third-party acts, or use outside the documented requirements.

Where liability cannot be excluded, ActiveTrader’s aggregate liability arising from the affected product or order will, to the fullest extent permitted by law, not exceed the amount actually paid to ActiveTrader for that affected product or order.

Nothing in these Terms limits liability for fraud, intentional misconduct, or another liability that applicable law does not permit to be excluded or limited.

Client Indemnity

To the extent permitted by law, you agree to compensate ActiveTrader for reasonable losses, claims, costs, or expenses caused by your:

  • unlawful use of the product or website;
  • material breach of these Terms;
  • licence sharing, resale, infringement, or circumvention;
  • false authority or false account-ownership representation; or
  • violation of another person’s rights.

This clause does not require you to compensate ActiveTrader for loss caused by ActiveTrader’s own fraud or intentional misconduct.

Force Majeure

Neither party will be responsible for delay or failure caused by events beyond reasonable control, including natural disaster, war, civil disturbance, government action, legal restriction, cyberattack, telecommunications failure, hosting outage, power failure, widespread platform failure, or failure of an essential third-party provider.

The affected party should take reasonable steps to reduce the impact and resume performance when practicable.

Privacy and Personal Data

Personal data is handled according to the ActiveTrader Privacy Policy and applicable data protection law.

Data may be processed where reasonably necessary for orders, payment verification, licence activation, downloads, security, fraud prevention, support, compliance, communication, and service improvement.

Please review the Privacy Policy for information about data categories, purposes, retention, disclosure, security, and available rights.

Complaints and Dispute Resolution

ActiveTrader wants complaints to be handled fairly and efficiently. Before starting formal proceedings, please contact official support with:

  • your name and order number;
  • the product and licence type;
  • a clear description of the issue;
  • relevant screenshots, logs, dates, and communications; and
  • the remedy you are requesting.

The parties should first attempt good-faith negotiation. If the matter is not resolved, the parties may consider mediation or another mutually agreed dispute-resolution process before court proceedings.

Nothing in this clause prevents either party from seeking urgent protection for security, intellectual property, fraud, or another matter requiring immediate relief. Mandatory consumer dispute rights remain unaffected.

Governing Law, Jurisdiction, and Language

These Terms are governed by the laws of the Republic of Indonesia, without removing any mandatory consumer protection that applies in the Client’s jurisdiction.

Subject to mandatory dispute-resolution rights, the competent courts of Indonesia will have jurisdiction over disputes that cannot be resolved through good-faith negotiation or an agreed alternative process.

These Terms may be published in English and Bahasa Indonesia. Where applicable law requires the use of Bahasa Indonesia, the required Bahasa Indonesia version will apply. If versions differ, the version required by applicable law will prevail to the extent of the inconsistency.

Changes to These Terms

ActiveTrader may update these Terms to reflect product, operational, security, legal, or regulatory changes.

The updated version will show a new “Last Updated” date. Material changes affecting an existing licence will not be applied retroactively to remove an already-paid core licence right unless required by law, necessary for security, or agreed with the Client.

Continued use after the effective date of an updated version means acceptance of the updated Terms for future use, subject to applicable law.

General Provisions

Entire agreement

These Terms, the order confirmation, the applicable product page, and referenced policies form the agreement for the relevant purchase unless a separate written contract states otherwise.

Severability

If a provision is invalid or unenforceable, it will be adjusted or removed only to the minimum extent necessary, and the remaining provisions will continue.

No waiver

Failure to enforce a provision immediately does not waive the right to enforce it later.

Assignment

You may not assign or transfer the licence or these Terms without written approval. ActiveTrader may assign operational rights or obligations as part of a lawful business transfer, restructuring, or service-provider arrangement, provided mandatory Client rights remain protected.

Electronic records

Orders, acceptance records, invoices, delivery records, activation logs, support communications, and electronic notices may be maintained and used as evidence of the transaction, subject to applicable law.
